According to
U.S. Patent and Trademark Office (USPTO) documents, Twitter's application for a trademark on "tweet" has been preliminarily denied since there are three companies - TweetMarks, Cotweet, and Tweetphoto sent the application first. Right now it has confirmed that Tweet is not the registered trademark of Twitter so far.
